John M. Leverett represents domestic and overseas real estate developers and builders in connection with the conception, planning, documentation, and regulatory approval of real estate developments, including mixed-use urban developments with hospitality, residential, retail, and apartment components, urban high-rise condominiums, age-qualified communities, master-planned residential developments, urban infill, adaptive re-use, live-work projects, and commercial/industrial projects throughout California.

Special Development Issues. Mr. Leverett has substantial experience with the unique governance and compliance issues encountered in complex, urban mixed-use developments involving residential, retail, hospitality, and commercial components (including the W Residences in Hollywood, 8600 Wilshire and 9200 Wilshire in Beverly Hills, and 1150 Wilshire and 1111 Sunset in Los Angeles), the redevelopment of former military bases (including San Francisco’s Treasure Island and the former MCAS Tustin), residential re-use of former commercial/industrial sites (including Executive Park and Candlestick Point in San Francisco), and development under SB35, including the redevelopment of Vallco Town Center in Cupertino. Mr. Leverett also advises on environmental issues encountered in repurposing former petroleum-producing lands for residential and commercial use, pre-acquisition due diligence on new and “broken” residential developments, and representing foreclosing lenders and mortgage GSEs in connection with restarting the development and sale of lender REO projects, up to and including sales to end-uses.

Builder Risk Management. Mr. Leverett also regularly advises on structuring protective provisions and disclosures in governance and sales documents relevant to construction defect risk management, and advises residential sales forces in connection with sales contracts, disclosure, and real estate licensing issues.

Regulatory Compliance. As a member of the development team, Mr. Leverett brings significant experience with the requirements of governmental agencies, including the California Department of Real Estate, the California Coastal Commission, US Army Corps of Engineers, EPA, state and local health and environmental agencies, cities, and counties.

Residential Lending Approvals. Mr. Leverett regularly assists developers of residential projects in planning for and securing project approvals from FHA, VA, Fannie Mae, and Freddie Mac.
